Reasons
1. Basic facts
A. On July 13, 2011, the Plaintiffs concluded a lease agreement with the Defendant and Seocho-gu Seoul Metropolitan Government to lease for the purpose of restaurant business with a lease deposit of KRW 270,000,000 per annum (hereinafter “instant store”) and rent of KRW 14,00,00 per month (excluding value-added tax) and management expenses of KRW 986,00 per month (excluding value-added tax) and from July 30, 201 to July 30, 2013.
On July 16, 2011, the Plaintiffs concluded a modified lease agreement with the Defendant to extend the lease term from July 30, 2013 to December 29, 2016, and to increase the rent from November 1, 2013 to KRW 17,00,000 per month (hereinafter “instant lease agreement”).
B. According to the instant lease agreement, the Defendant received the instant store from the Plaintiffs, and obtained permission from the head of Seocho-gu as stated in the separate sheet (hereinafter “instant business permission”), and operated a scaloid store with the name of “F store” at the instant store from the end of July 201 to the end of July 201.
C. On July 2016 and November 201, 2016, the Plaintiffs requested the Defendant to order the instant store by January 6, 2017 when notifying the Defendant of the termination of the instant lease agreement upon the expiration of the period.
Since then, the Plaintiffs and the Defendant agreed to order the instant store until May 30, 2017 after consultation on the date of the order, and on February 15, 2017, the Defendant drafted and issued a “a letter of agreement on the implementation and extension of business,” stating that “The instant store is ordered to the Plaintiffs by May 30, 2017, and the existing lease agreement is recognized to have been terminated on December 29, 2016.”
The Defendant delivered the instant store to the Plaintiffs on May 31, 2017, and the Plaintiffs returned the remainder of the lease deposit under the instant lease agreement to the Defendant.
