A defendant shall be punished by imprisonment for two years.

Punishment of the crime

The Defendant is the representative director of G Co., Ltd. (hereinafter referred to as “G”) established for the purpose of planning, manufacturing, and supplying public telephone cards.

[Fact-finding] Korea Communications Co., Ltd. (hereinafter “H”) established as a subsidiary company of the Korea Communications (hereinafter “KT”) (hereinafter “H”), a public corporation, began to conduct the business of manufacturing, supplying, etc. public telephone cards, and then sold them to I (hereinafter “I”) established by the Defendant in accordance with the policy of the privatization of public corporations around 1999. G, the largest shareholder of I succeeded to H and took over the business of manufacturing, etc. public telephone cards from Korea, and the Defendant is the representative of G, the parent company of G, and was acting as the representative director of G from April 206.

G concluded an agreement on the manufacture and supply of public telephone cards with KT Co., Ltd. (hereinafter referred to as "KT") every year, and manufactured and supplied KT-registered public telephone cards. On December 20, 2005, K and G entered into an agreement on the manufacture and supply of public telephone cards (hereinafter referred to as "agreement").

According to the above agreement, ① the public telephone card is classified into “general card” sold to the general public for sale, ② the card is classified into “order card” issued by the customer’s order by inserting letters or designs desired by the customer (type of card), ② the card is entrusted to G with the manufacture of general card and order card manufacture and sale business (the contents of the business entrustment) from January 1, 2005 to December 31, 2006, ③ the card is issued in the name of KT, ③ the card is issued in the name of KT, and the face value, size, information, information, and other matters related to the issuance and sale of the card shall be determined by KT. However, the selling price of the order card sold by G shall be determined by consultation with KT and (the method of performing the entrusted business) and ④ the amount calculated by deducting the manufacturing cost of KT from the selling price of the order card after deducting the manufacturing cost from the manufacturing cost of G (the settlement of the purchase price) and ⑤ the general card shall be immediately paid after deliberation by the Do Deliberation Committee.
