A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On July 2012, the Defendant continued to receive the so-called “work loan” from a financial institution by means of false documents, etc. through the Internet site search, and continued to use the loan by taking advantage of the name-based “C”, “D”, “E”, “F” and “F” through the false charter contract with the Defendant.

However, in fact, the Defendant did not actually conclude the above lease contract, and since the lease deposit was not paid, the pledge was not meaningful, and even if the loan was executed, the Defendant did not have the intent or ability to pay the principal and interest normally.

Nevertheless, the Defendant, on August 20, 2012 (the indictment is written in writing as of August 20, 2013, but according to evidence, he/she was approved of loans from the name of the said bank staff member and transferred KRW 60 million to a foreign exchange bank account opened in the name of the Defendant after obtaining approval for loans from the said bank staff member’s name, which is believed to be true.

Accordingly, the Defendant received money and valuables by deceiving the victim in collusion with the above-mentioned work loan business operator.
