나. 피고인은 2015. 12.경 전남 화순군 P아파트 ＊＊＊동 ＊＊＊호에서 피해자(당시 25세)를 갑자기 껴안아 피해자를 바닥에 눕힌 후 피해자 위에 올라 타 피해자의 몸을 누르며 반항을 억압한 후 피해자의 가슴을 빨고, 피해자의 바지와 팬티를 벗겨 피해자의 음부에 피고인의 성기를 삽입하여 강간하였다.

다. 피고인은 2016. 2.경부터 2016. 3.경까지 사이에 전남 나주시 Q아파트 ＊＊＊동 ＊＊＊호에서 잠을 자고 있던 피해자(당시 25세)에게 다가가 피해자의 가슴을 빨다가 잠에서 깨어난 피해자가 피고인을 밀쳐내자 피해자의 몸 위에 올라 타 피해자의 몸을 누르며 반항을 억압한 후 피해자의 팬티를 아래로 내리고 피해자의 음부에 피고인의 성기를 삽입하여 강간하였다.
