Reasons
Punishment of the crime
[Publically recruited facts] around June 2019, Defendant A conspiredd with G(one name “D”, “E”, “F”) and 40 men, etc. called “Nging,” and Defendant A planned to submit false documents as if he was in the workplace, using the fact that small loans operated by a financial institution were inevitably made only by a simple examination. Specifically, Defendant A was in charge of creating a false employment certificate, etc.
On the other hand, around June 11, 2019, Defendant B contacted Defendant A through G, submitted false employment documents to Defendant A for explanation about the method of borrowing loans, conspired to receive loans under his/her own name, and notified Defendant A of his/her resident registration number, etc. to Defendant B, etc., and caused Defendant B, etc. to create a certificate of employment and a receipt for tax withholding for wage and salary income as if Defendant B were an employee at the court with the office of I in Michuhol-gu Incheon, where Defendant B was an employee in the office of I, and received education on specific loan methods from Defendant A.
[Specific Crime]
1. The Defendants’ fraud committed an act of raising credit by submitting false documents as if Defendant B were to work as an employee of the J, even though the Defendants did not have any property without a certain occupation, and even if they did not have any intent or ability to repay the loan from the K Bank, the Defendants were to receive loans by raising credit rating.
Accordingly, the Defendants, at around 15:00 on June 13, 2019, filed a loan application by submitting a false certificate of employment and a false receipt of tax withholding for wage and salary income, as Defendant B would be an employee in charge of loan at the K Bank M Center located in Nam-gu Incheon Metropolitan City L.
