1. As to KRW 81,419,355 out of KRW 95,850,386 and the said money, Defendant C Co., Ltd. from July 27, 2017 to KRW 81,419,355.

1. Determination as to Plaintiff A’s claim against Defendant C

A. Comprehensively taking account of the overall purport of arguments in Gap evidence Nos. 2, 3, and 4 (including branch numbers; hereinafter the same shall apply) as to the cause of the claim, the above plaintiff was notified of dismissal without notice on July 27, 2017 after entering the above defendant company on January 21, 2016 and served until that day. The above defendant company did not pay wages and retirement allowances to the above plaintiff during the above service period. The above defendant company did not pay wages and retirement allowances to the above plaintiff, the wages that the above defendant company did not pay to the above plaintiff can be acknowledged as stated in the attached Table 1 "A-year calculation statement of wages," and retirement allowances in the attached Table 2 "statement of calculation of retirement allowances."

According to the above facts, the above defendant company is obligated to pay 84,903,226 won for unpaid wages, retirement allowance of 6,947,160 won for retirement allowance of 30 days, and advance notice of dismissal allowance of 4,00,000 won for ordinary wages of 95,850,386 won, and delay damages therefor, unless there are special circumstances.

B. Determination 1 as to Defendant C’s assertion that the above Defendant Company received wages in the account of Plaintiff A, but it is insufficient to acknowledge the above assertion only with the entries in the evidence Nos. 4 and 13, and there is no other evidence to acknowledge it. Thus, the above Defendant Company’s assertion is without merit. 2) The above Defendant Company asserted that the money used by the above Defendant Company’s corporate card by the above Defendant Company was no money to be paid to the above Plaintiff when it deducts the amount within the amount equal to the above Plaintiff’s claim amount because the money used by the above Defendant Company’s corporate card by the above Defendant Company was greater than the above Plaintiff’s claim amount, but there is no money to be paid to the above Plaintiff. However, there is no other evidence to acknowledge it

C. From July 27, 2017, the Plaintiff Co., Ltd. seeks to pay the unpaid amount of KRW 81,419,355 out of KRW 95,850,386 and the said amount, excluding the wages of July 7, 2017.
