Reasons
Punishment of the crime
Defendant
A is a person who collects, stores, distributes, and sells F illegally captured in Busan (hereinafter referred to as “F”) as the head of the Busan District Office of the E Federation. Defendant B is a person who collects, stores, distributes, and sells F illegally captured in the whole country with the chairperson of the E Federation.
1. No one shall possess, distribute, process, keep or sell fishery resources or products captured and collected in violation of any statute;
Nevertheless, on March 1, 2013, Defendant A, even though he/she was aware that he/she was captured by H at the sea near the bank of Gangseo-gu Busan Metropolitan Government, with the knowledge of the fact that he/she was captured by F 100 mar in the near the bank of Gangseo-gu, Busan Metropolitan City, the domicile of Defendant A, purchased at KRW 400,000 and sent it to B for high-speed bus cargo services.
From around that time to May 15, 2017, including sales, purchased a total of KRW 781,686 ma from the illegal capturer to KRW 1,581,46,180, and distributed it to B, such as the list of crimes (1) in attached Table 2,189.
2. Defendant B
(a) No person who violates the management of fishery resources shall possess, distribute, process, keep or sell fishery resources or products captured and gathered in violation of statutes;
Nevertheless, Defendant B purchased KRW 1,095 Mar. 27, 2013, for KRW 4,54,250 of the F1,095 Mar. 27, 2013, and transported it to K operated by Defendant B, and sold its trade name in a food farm with no known information, and distributed the total amount of F 781,686 Mar. 148 times from around that time to May 15, 2017, by purchasing KRW 1,712,80,100 for total amount of KRW 148 times, such as the daily list of crimes (2) in attached Form 1,786 Mar. 15, 2017.
B. On May 2015, Defendant B forged a private document with intent to make a false tax return by receiving a request from a police officer of the early 2015 to request a tax return instead of a tax return.
