A defendant shall be punished by imprisonment for two years.

The defendant shall pay 139,765 won to the applicant for compensation by fraud.

3.2

Punishment of the crime

On December 20, 2012, the Defendant was sentenced to imprisonment of one year and four months for fraud at the Seoul Western District Court on December 20, 2012, and completed the execution of the sentence on December 7, 2013.

1. On March 4, 2014, the Defendant: (a) prepared a notice stating that the victim D purchases the “new call” on the Internet bulletin board of the NAV, a website, using a cell phone at an insular place; and (b) fraudulently stated that the Defendant sold the said new call via the Kakao Stockholm message.

However, in fact, the Defendant did not have any intention or ability to send a new attack even if he received the price for the goods from the above victim.

The defendant acquired 1,700,000 won from the victim to the agricultural bank account in the name of the defendant as a price for goods.

In addition, from around that time to July 7, 2014, the Defendant acquired total sum of KRW 42,021,765 from 125 victims to the account in the name of the Defendant for the payment of goods through the said method over a total of 125 times from 125 victims, as shown in attached Table 1.

2. No person who violates the National Sports Promotion Act shall gambling in use of a prohibited act in which property or property benefits are provided to persons who win at the betting ballots or similar things by issuing sports betting tickets or similar things to those who win at the betting;

At around 10:10 on March 24, 2014, the Defendant, using a computer, connected AdiG to “F” the website of the Internet sports-based sports-based website, and deposited KRW 100,700 to the national bank account in the name of H, a corporation that the above site operator designated as the gambling fund deposit account, and deposited the corresponding game money, and won was charged at the above site, and was on the eficial sport, such as a domestic or foreign axis, camping, etc. at home and abroad.
