Reasons
Punishment of the crime
[2015 Highest 2464] Defendants are those who enter Korea as a ship of Chinese nationality and reside therein.
Defendant
A has been aware of the fact that he/she had been staying in China (one name G, the same day suspension of prosecution) and gambling, and has maintained contact with G. Defendant B has received G from a person who is a “H” residing in China at the end of June 2015, and has maintained contact with G after having been introduced from a person who is a “H” residing in China.
Since then, the Defendants and G planned and controlled the crimes of Bosing by G, and the Defendants conspired to take charge of the role of generating money by intrusioning into the house of the victims in which G had colored according to the direction of G.
1. According to the Defendants’ joint criminal administration plan, G calls around 13:00 on July 2, 2015 to the victim D (here, 79 years of age), and “B is an incumbent police officer, who is issued a credit card under the name of the party and wants to withdraw money from the passbook. In order to prevent damage, he/she withdraws the money deposited in the passbook and makes it available to the victim’s national bank account at around 13:20 on the same day to withdraw KRW 37 million in cash from the victim’s national bank account at around 13:20 on the same day, and has the victim keep the money in subrogation of the victim’s house, and thereafter, he/she again calls to the victim at the time.” The mail office at Nowon-gu, Seoul Special Metropolitan City, Nowon-gu, issued a credit card under the name of the party and gave the victim a credit card under the name of the party, and then requested the victim to do so.
Defendant
A, at around 15:18 of the same day according to the above G instructions, with a key to the second floor mail of the above apartment house, and the elevator and the corridor up to the 6th floor was invaded upon the victim's residence, but the apartment security guards, who conducted patrol, escaped from the victim's house.
