Reasons
Punishment of the crime
1. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Bodily Injury resulting from Dangerous Driving) is a person engaged in driving cars B 125cc.
On November 30, 2018, at around 03:29, the Defendant driven a two-laned vehicle with the blood alcohol concentration of 0.132%, and led to the flow of the two-lane road at an insular speed in accordance with the direction of the red-passing zone from the bank of the residents' center in Western-dong.
At night, a person engaged in driving service is at night, and in such cases, he/she has a duty of care to not drive a vehicle at a speed or in such a manner as to cause danger and harm to others depending on road structure and traffic conditions by accurately operating the steering system, brakes, and other devices of the vehicle.
Nevertheless, the Defendant, while under the influence of alcohol, led to the collision of the front part of the said two-wheeled vehicle and the opposite part of the said two-wheeled vehicle, which was driven by the victim C (Nam, 55 years old) who was driving along one lane in front of the said two-wheeled vehicle.
As a result, the Defendant suffered injury to the victim E (the 25 years old), who was on board the said two-wheeled vehicle with normal driving due to influence of alcohol, such as a tension in the tension of the climatic base, which requires three weeks of medical treatment. The Defendant suffered injury to the victim F (the 46 years old), the passenger of the said taxi vehicle, and the victim G (the 40 years old, the 40 years old, the knife) for two weeks of medical treatment.
2.
