1. Basic facts

가. 원고들은 2012. 6. 29.부터 2013. 4. 25.까지 사이에, ① 피고 농업회사법인 주식회사 파란농장들(이하 ‘피고 파란농장들’이라고 한다)과는 1구좌당 6,000,000원을 계약금액으로 지급하고 양돈사육을 위탁하여 14개월의 계약기간 만료시 1구좌당 성돈(成豚) 20마리를 지급받기로 하는 각 양돈사육계약(이하, ‘이 사건 각 양돈사육계약’이라고 한다)을, ② 피고 농업회사법인 주식회사 도나도나(이하 ‘피고 도나도나’라고 한다)와는 이 사건 각 양돈사육계약 당일 이 사건 각 양돈사육계약에 따라 피고 파란농장들로부터 지급받을 성돈(1구좌당 20마리)을 피고 도나도나에 1마리당 390,000원 또는 381,000원에 선물매도하고, 계약기간(계약일로부터 14개월) 만료일로부터 7일 이내에 선물매매대금을 12회에 걸쳐 분할지급받기로 하는 각 성돈 선물매매계약(이하 ‘이 사건 각 선물매매계약’이라고 한다)을 각 체결하였다.
