A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

【Public offering to engage in the phishing fraud” in misrepresenting to an unspecified person by calls, “A may make a substitute loan to repay a part of the existing loan to increase the credit rating in order to be able to lend a loan,” thereby receiving money by means of a remittance to an account (one-person account referred to as “one-person passbook account”) which has been secured in advance.

Accordingly, C was equipped with the telephone, computer, etc. necessary to commit each crime by leasing a two-story store in the Chinese Cheongdo and a two-story store near the department store store in China, and formed a "phishing team" to induce deposit transfer, a "Stopbook solicitation team" to collect money to be deposited by fraud, and a "Stopbook solicitation team" to collect data bees containing contact numbers of unspecified people and provide them to D and E as the team leader.

Upon C’s instruction, the said D and E distributed the said database to the phishing team so that the team members can utilize it for committing the crime, and the phishing team members managed the phishing team. The phishing team members, using the said database, induced a large number of unspecified persons to transfer the funds in the above manner.

C was employed by the Defendant, F, G, H, I, J, K, L, M, M, N, P, Q, R, R, T, and U.

Accordingly, each of the above members including the defendant and C conspired to acquire money by receiving money from the recipient of it through the access media of other people.

【Contents of the Defendant’s participation in the commission of the crime】 The Defendant used the name of “V agency” at the above Bosing Office in China’s Cheongdo and China’s Republic of China from May 2013, and worked as a member of the Washington Team.
