Punishment of the crime

[2013 high-level 5665] The defendant is a user who runs software development business using 50 full-time workers as a representative director of C (main) in the second floor of Gangnam-gu Seoul Metropolitan Government B building B.

1. When a worker dies or retires, the employer shall pay the wages, compensations, and other money or valuables within fourteen days after the cause for such payment occurred;

Nevertheless, the Defendant is working from May 17, 2010 to March 11, 2013 at the above workplace.

With respect to retired D's wages of 1,288,917 won on February 2, 2013, and of 722,477 won on March 2013, 2013, the total amount of 2,011,394 won was not paid within 14 days from the date of retirement without any agreement between the parties on extension of the due date.

2. When a worker retires, the employer shall pay the retirement allowance within fourteen days after the cause for such payment occurred; and

Nevertheless, the Defendant is working from May 17, 2010 to March 11, 2013 at the above workplace.

The retirement allowance of 5,818,306 won for retired D was not paid within 14 days from the date of retirement without any agreement between the parties on the extension of the due date.

[2013 high-level 6114] The defendant is a user who runs software development business using 50 full-time workers as a representative director of C (main) in 1111 of the E building in the Sung-nam City.

1. When a worker dies or retires, the employer shall pay the wages, compensations, and other money or valuables within fourteen days after the cause for such payment occurred;

Nevertheless, the Defendant is working from November 8, 2010 to March 12, 2013 at the above workplace.

With respect to retired F, the sum of wages of KRW 1,367,51 on February 2, 2013, and KRW 2,247,549 on March 2, 2013, including wages of KRW 879,998 on March 3, 2013, was not paid within 14 days from the date of retirement without any agreement between the parties on extension of the due date.

2. When a worker retires, the employer shall cause the payment thereof.
