Reasons
Punishment of the crime
In operating the Victim C Co., Ltd. (hereinafter referred to as the “victim”) representative D and June 1, 2013, the Defendant: (a) drafted a written agreement or loan certificate for the operation of the store; (b) operated the “C book store” from June 1, 2013 to January 31, 2015 in Nam-gu, Seoul; (c) operated the “C book store” from the “C book store from October 30, 2014 to May 1, 2015; and (c) operated the “C book store from the Dong-gu, Gwangju (based on the C book store sales contract) from the “C” company from the “C book store from October 30, 2014 to May 1, 2015; and (c) sold the mobile phone from the victim Company and C book store from the impulse and received the sales proceeds and the fees from the victim; and (d) deposited the proceeds from the contract with the victim.
1. Occupational embezzlement;
A. On August 4, 2014, the Defendant sold 198,000 won of a mobile phone owned by the victim company, which was kept in the advantage of Section C in Gwangju Dong-gu, Gwangju, without the consent of the victim company, and then embezzled the proceeds by selling 41,075,10 won of a total market price of 49 mobile phone from May 1, 2015 to May 1, 2015, including the fact that the proceeds were consumed for personal use, such as office operation expenses and employee pay, from that time, from the time to May 1, 2015.
B. On October 27, 2014, the Defendant embezzled KRW 828,000,000 remaining after selling mobile phone H in cash 878,000 won to I for the victim company in his/her occupational custody from the impact impact in Gwangju Dong-gu, Gwangju on October 27, 2014, including around that time, he/she used the 65 mobile phone for personal purposes, until February 23, 2015, by selling 47,676,700 won in cash and excluding KRW 2,08,000,000,000 for sales commission, and embezzled it for personal purposes.
