A defendant shall be punished by imprisonment for two years.

Punishment of the crime

1. Around January 7, 2008, the fraud defendant against the victim B made a false statement to the victim B in the Dunusea room operated by the defendant in Yangju-si, which reads as follows: "When the house is completed, he/she will obtain a single house and make a repayment at once."

However, in fact, there was no intention or ability to pay the amount of KRW 200 million even if the victim borrowed money without any specific property at the time.

On January 17, 2008, the Defendant, as described in the attached Table of Crimes (1), by deceiving the victim as such, and receiving KRW 9 million from the victim as the borrowed money, around January 17, 2008, from around nine times to around April 30, 2010, received delivery of KRW 60,2140,000 from that time.

2. Fraud to victims E;

A. On March 30, 2010, the Defendant made a false statement to the victim E that “A money is needed to see beauty rooms in the F apartment commercial building in Yangju-si. If the Defendant borrowed money, the Defendant would pay interest on the second day of each month and pay the principal money.”

However, as above, there was no intention or ability to repay the above even if the victim borrowed the money from the victim.

The Defendant, as such, by deceiving the victim, received KRW 10 million from the victim as the borrowed money.

B. On December 16, 2010, the Defendant concluded that, “Around December 16, 2010, the Defendant borrowed money to the victim E in return for the purchase of the vehicle in South and North Korea, which would be 600,000 won per month.” On the other hand, the Defendant would pay money to the victim E in return for the second and rapid payment of interest.”

However, as above, there was no intention or ability to repay the above even if the victim borrowed the money from the victim.

The defendant deceivings the victim and is under his control.
