The judgment of the court below is reversed.
A defendant shall be punished by imprisonment for two years.
Reasons
1. The sentence imposed by the court below (three years of imprisonment) on the summary of the grounds for appeal is too unreasonable.
2. Each of the instant offenses is an unfavorable circumstance to the Defendant, such as the following: (a) the Defendant, by forging or falsifying a bill of lading, a trade agreement, a siren, etc. and exercising its original or copy by means of using the original or copy of the bill of lading; (b) pretended to have been exported by shipping the goods on the date of shipment stated in the bill of lading; (c) obtaining a purchase foreign exchange loan from the victim’s new bank and the national bank; (d) the crime is not good because the method of committing the crime is inferior and the amount obtained by deception reaches US$ 4660,00; and (e)
However, the Defendant recognized all of the crimes and reflects his mistake in depth, and the Defendant faithfully repaid the obligation to purchase foreign exchange loans to victims prior to each of the crimes of this case, and the Dispute Resolution Committee has consistently been exported before and after each of the crimes of this case, and the Defendant does not seem to have any intention to obtain the purchase foreign exchange loans in a conclusive manner at the time of each of the crimes of this case, and the profits accrued from each of the crimes of this case are not deemed to have been personal useful by using the funds for the operation of the Dispute Resolution Committee. The Defendant appears to have invested a considerable personal property in the course of the rehabilitation of the Dispute Resolution Committee in the Case Resolution Committee, and some of them appears to have been partially repaid to the victims, and there is no criminal history of the same kind of crime, and there is no history of criminal punishment exceeding the fine, etc. are favorable to the Defendant.
In addition, in full view of the various circumstances, including the defendant's age, sex, environment, relationship with the victim, motive or circumstance of the crime, and circumstances after the crime, the punishment sentenced by the court below is too unreasonable.
Therefore, the defendant's status.
