The sentence of sentence against the defendant shall be suspended.

Punishment of the crime

피고인은 2013. 11. 25. 경 E 와 단팥빵 제조판매 사업을 경영하기로 하는 동업계약을 체결하고, 서울 중구 F 소재 G 역사 내 매장을 임차하여 ‘H’ 이라는 상호로 동업체 조합( 이하, ‘ 피해자 조합’ 이라고 한다) 을 운영하는 업무에 종사한 사람이다.

한편, 피고인과 E는 I 피해자 조합이 제조판매할 단팥빵 등 상품에 관하여 ‘J’ 라는 명칭으로 서비스 표를 공동 출원하여 특허청의 심사가 계속 중이었으므로, 피해자 조합의 운영업무에 종사하는 피고인으로서는 위 서비스 표와 동일 또는 유사한 명칭의 서비스 표나 상표를 피고인 명의로 단독 출원함으로써 일반 수요자들 로 하여금 상품의 출처 또는 품질에 대한 오인 혼동을 유발하는 등으로 피해자 조합의 이익을 해하여서는 아니 될 업무상 임무가 있었다.

Nevertheless, on April 15, 2014, in violation of the above duties, the Defendant filed a separate application under the name of the Defendant for a trademark under the same name as that of another person’s prior registration trademark, mark, and designated goods, which are identical or similar to the service table under the examination of the Korean Intellectual Property Office. However, on May 1, 2015, the Defendant refused registration from the Korean Intellectual Property Office on the ground that the trademark and mark are identical or similar to those of another person’s prior registration.

As a result, the Defendant violated the duty of business pertaining to the victim union, thereby causing property damage equivalent to the value of trademark rights, the market price of which is unknown based on the sole application of the said “J” trademark to the victim union, and intended to obtain property profit equivalent to the same amount. However, the Defendant failed to achieve that intent and attempted to do so.
