1. Fraud;
A. Around March 12, 201, the Defendant, as a person who runs the hospital interior work, concluded a false statement to the effect that “The Defendant would complete the payment of construction cost immediately after the completion of the construction work at the site of the first floor of the Dental Hospital Eental Hospital in Gangnam-gu, Seoul, and the victim F at the construction site of the Dental Hospital in Gangnam-gu.”
However, the defendant did not have the intent or ability to pay the full amount of the construction cost to the victim even if the victim completed the interior work due to excessive personal debt.
Nevertheless, as above, the Defendant: (a) made the victim make a false statement from March 13, 2013 to November 4, 201 of the same month; (b) had the victim carry out a medical care work equivalent to KRW 26,966,80 of the construction cost; and (c) had the victim complete the medical care work equivalent to KRW 34,981,975 of the total construction cost between March 22, 2011 to June 4, 2011; and (d) had the victim obtain property benefits equivalent to KRW 21,200,000 out of the construction cost; and (e) had the victim paid KRW 1371,781,975 of the difference among the construction cost to November 1, 201.
B. On May 15, 201, the Defendant, as a person who runs a hospital artificial medicine construction business, concluded a false statement to the effect that “A victim I would immediately settle the construction cost on the site of the artificial medicine clinic located in Ansan-si G at the site of the artificial medicine hospital located in Ansan-si, Seoul Special Metropolitan City.”
However, the defendant did not have the intent or ability to pay the cost of construction to the victim even if the victim completes the interior work due to excessive personal debt.
Nevertheless, the defendant shall make the above false statement and have the victim complete the above construction work on or around May 201, and then the payment for the construction work shall be 300.
