(However, Article 208(3)2 and Article 150 of the Civil Procedure Act of confession judgment rendered on February 2, 199: The defendant only served the original copy of the payment order and submitted a formal written objection; the defendant did not submit a substantive written response disputing the plaintiff's claim thereafter; and the plaintiff did not appear on the date for pleading; therefore, the plaintiff's assertion is deemed to have been led to the confession.

Since the provisions on statutory interest rate under the main sentence of Article 3(1) of the Act on Special Cases concerning Expedition, etc. of Legal Proceedings were amended by Presidential Decree No. 26553, Oct. 1, 2015 to be 15% per annum, part of the Plaintiff’s claim for delay damages is dismissed.
