A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

피고인은 2018. 4. 6. 16:10 경 대구 중구 C에 있는 'DDVD 방 '에서 피해자 E( 가명, 여, 18세) 과 단둘이 있게 되자 피해자에게 갑자기 키스를 하였으나 피해자가 고개를 돌리며 거부하자 피해자를 강간할 마음을 먹고, 양손으로 피해자의 양쪽 손목을 잡아 움직이지 못하게 하고 모친에게 전화를 하려고 하는 피해자의 팔을 잡아 제지하는 방법으로 피해자의 반항을 억압한 후, 손으로 피해자의 가슴을 만지고, 피해자가 피고인의 손을 치고 뺨을 때리고 몸을 밀치며 거부하였음에도 불구하고 피해자의 왼쪽 가슴을 강하게 주무르고 피해자의 상의와 브래지어를 올려 가슴을 핥으려고 하고, 피해자에게 “ 니가 너무 이뻐서 성관계하고 싶다” 고 말하며 피해자의 바지 속으로 손을 넣어 피해자의 바지 벨트를 풀어 강간하려고 하였으나 피해자가 저항하는 바람에 미수에 그쳤다.
