피고인과 C은 위 F, G과 함께 같은 날 02:00경 안산시 상록구 일동 산 68-1에 있는 야산 입구로 피해자들을 데리고 간 후 그 곳에서 C은 피해자들에게 바닥에 엎드리게 한 다음 피고인에게 “빳다 쳐”라고 지시하고, 피고인은 위 C이 지켜보는 앞에서 C의 지시에 따라 준비한 위험한 물건인 각목(길이 약 1m)으로 피해자들의 엉덩이와 허벅지 부위를 각 20회 가량 때리고, F, G은 “형들한테 실수를 하면 돼”라고 말하면서 피해자들 옆에 서서 피해자들이 도망가거나 반항하지 못하도록 위력을 과시하였다.
