1. All of the plaintiffs' claims are dismissed.
2. The costs of lawsuit are assessed against the plaintiffs.
Reasons
1. Basic facts
A. L (Death of November 23, 1982) is a son of M (Death of July 4, 1995). Plaintiff A is a wife of L, Plaintiff B, C, D, E, F, G, H, I, and J are L’s children, and are co-inheritors.
B. Around August 4, 1955, M has completed registration of preservation of ownership with respect to 14,182 square meters of O forest and P forest land and 9,471 square meters (hereinafter “forest and forest subject to clearing in this case”) located in Gangseo-gun, Gangwon-gun, Gangwon-do (hereinafter referred to as “land number marking”) around August 4, 195, and changes thereafter are as follows.
Defendant 19,471 square meters (30,90 square meters) of P 9,38,168 square meters (30,99.4.8) of forest land subject to reclamation; and Plaintiff 14,182 square meters of O forest land (4,290 square meters) of 1980.6.21, 1980 (11, 1980.6.11, 1980) of 9,471 square meters (30,90 square meters) of P 38,168 square meters (1.8, 1986.4.8); Plaintiff 16,036,036,500 square meters of G 195.17 (19.4.0,95.195.17.35.19,95 square meters of G forest land) of 9,195.17 (195.4.195.7.4.195)
C. On November 25, 1967, the head of Si/Gun determined and publicly announced the forest subject to the instant land to be reclaimed, subject to a resolution of the Land Development Committee pursuant to the former Farmland Creation Act (amended by Act No. 2767 of Apr. 11, 1975; hereinafter “former Farmland Creation Act”). Accordingly, in accordance with the above decision and public notice, MaB decided to carry out the development project for the land owned by another person (hereinafter “the development project of this case”) with respect to the forest subject to the development of this case pursuant to the above decision and public notice, and on December 10, 1967, a letter of transfer of right 24,000 square meters in the sum of 3,000 square meters in O land and 21,000 square meters in P land and 24,000 square meters in total among P land is included in the transfer area column, but the above area is determined as the permitted area for the development of land, considering the relevant evidence.
