A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
The defendant is a person who engages in real estate sale business.
The Defendant: (a) leased KRW 140,000,000 to C with the guarantee deposit of KRW 10,000,000 for the rent of KRW 107,00 of 10,00 apartment units B, which he owns, and (b) applied for a loan to the bank, the Defendant was able to obtain a loan by forging a lease contract of KRW 30,00,000,000, which is a security value and submitted to the bank.
1. On September 4, 2014, the Defendant, at the home of the Defendant, 102, 300,000 won of the apartment lease contract, the deposit money, the rent of KRW 500,000 per month, and the lessee: The lessee of the apartment lease contract in the name of C, stating the name of B, 107, 108 C, the apartment lease contract (monthly rent) in the name of Chuncheon-si, Gangwon-do, and output it and the original apartment contract in the name of C.
C’s seal was affixed and copied.
Accordingly, for the purpose of exercising, the defendant has forged one chapter of apartment lease contract in the name of C, a private document on rights and obligations.
2. On September 4, 2014, the Defendant: (a) around September 4, 2014, at a lending-based office for the branch offices of the victim original agricultural cooperative, the single-gu agricultural cooperative, the single-gu branch office located in the original city, and (b) filed an application for a loan with the above apartment as security; and (c) submitted to the head of the division in charge of loan, who is an employee of the victim, who may not know that the apartment was forged, a lease deposit was KRW 30,000, to use the above forged lease contract as a document for the examination
3. The Defendant, at the same time and place as set forth in paragraph 2, filed an application for apartment mortgage loan with the head of the division in charge of loan, who is an employee of the branch office of the non-gu Agricultural Cooperative of the injured party, as the material for loan examination, as if the above forged lease contract was duly formed.
However, in fact, since the lease deposit of the above apartment is KRW 140,000,00,000, the actual security value is 110,000,000,000 rather than the report.
