The prosecution of this case is dismissed.

1. On September 16, 2013, around 05:40 on September 16, 2013, the Defendant: (a) committed assault by the victim D (the age of 64) who resides adjacent to the Defendant’s house in Ansan-si, the Defendant 2, on the ground that the victim D (the age of 64) who was living adjacent to the Defendant’s house in Pyeongtaek-si, was frequently booming the victim’s breath on several occasions on the part of the convenience store; (b) 3 times the victim’s left face due to drinking, and (c) taken the victim’s body going beyond the floor.

2. The instant public prosecution is dismissed in accordance with Article 327 subparag. 6 of the Criminal Procedure Act, since the victim expressed his/her wish not to punish the Defendant on or around December 9, 2013, which was after the instant public prosecution was instituted.
