9. 01:23경 대구 남구 B에 있는 ‘C’ 부근 도로에서 술에 취한 상태로 D 포터 화물차를 운전하다가 위 도로 2차선 위에 위 화물차를 정차한 상태로 잠을 자던 중, 같은 날 03:00경 위 장소를 순찰중이던 대구남부경찰서 E계 경위 F으로부터 피고인의 입에서 술냄새가 나고 발음이 부정확하며 걸음걸이가 비틀거리는 등 술에 취한 상태에서 운전하였다고 인정할 만한 상당한 이유가 있어 그때부터 같은 날 03:44경까지 3회에 걸쳐 음주측정기에 입김을 불어넣는 방법으로 음주측정에 응할 것을 요구 받았음에도 입김을 불어넣는 시늉만 하는 등으로 이를 회피함으로써 정당한 사유 없이 경찰공무원의 음주측정요구에 응하지 아니하였다.
