A defendant shall be punished by imprisonment for one year.
except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
In collusion with D, E, and F from February 2012 to March 201 of the same year, the Defendant introduced the lending company to the said D, etc., while G and H are the lessor as if they were the lessor. The aforementioned D, E, and F obtained a loan from a lending company as collateral for a forged lease contract, and the Defendant conspired to collect 10-20% of the loan at a fee in sequence.
1. On February 2, 2012, according to the above conspiracy, the Defendant introduced D to obtain a loan from the victim (ju) KHH LV credit company located in 17-7, Songpa-dong, Songpa-gu, Seoul. On February 2, 2012, G prepared a letter of agreement to provide the above apartment lease deposit amount of KRW 200 million to the victim company as security, and D presented a charter contract with the whole lease deposit amount of KRW 200 million which was forged as KRW 200,00,000,000,000,000,000,000,000,000 won.
However, G was not a lessor of the above apartment house, and D was residing in the above apartment house with a deposit of KRW 20 million, monthly rent of KRW 1.5 million, and there was no deposit of KRW 200 million, and there was no intention or ability to repay the loan in excess of the debt without any particular profit.
The Defendant, in collusion with D and G, by deceiving the victim as such, received a total of KRW 100 million from the victim, including KRW 20 million, and KRW 80 million on February 3, 2015, from the victim’s bank account in the name of D on the same day.
2. On February 20, 2012, the Defendant introduced F to F on February 20, 2012, the Defendant received a loan from the victim (ju) KHH LH credit company located in Songpa-dong, Songpa-gu, Seoul to obtain a loan from the victim (ju) 17-7, Songpa-gu, Seoul. On the same day, the nameless person is as if he/she was the lessor of K apartment 104 Dong 1603, Seongdong-gu, Seongdong-gu, Seoul, and the F is the said apartment.
