As to damages for delay under Articles 208(3)1 and 257 of the Civil Procedure Act of the applicable provisions of the Acts, the Plaintiff claimed payment of damages for delay calculated at the rate of 15% per annum from the day following the service of the original copy of the instant payment order. However, pursuant to Article 2(2) of the Addenda of the Regulations on Special Cases Concerning the Promotion, etc. of Legal Proceedings (wholly amended by Presidential Decree No. 29768, May 21, 2019), the Plaintiff recognized damages for delay calculated at the rate of 12% per annum from June 1, 2019.
