1. The Plaintiff (Counterclaim Defendant) paid KRW 18,00,000 to the Defendant (Counterclaim Plaintiff) and its related amount from November 25, 2013 to September 5, 2017.

A principal lawsuit and a counterclaim shall be deemed simultaneously.

1. Basic facts

A. On March 20, 2007, C Co., Ltd. (hereinafter “C”) entered into a sales agency contract with D (hereinafter “D”) with the content that C will carry out the sales of H commercial buildings to be newly constructed in the G zone located in Sungnam-si E and F (hereinafter “instant building”).

B. On December 30, 2009, the Defendant, as an investor of C, purchased the right to sell the instant commercial building Jho-ho (hereinafter “instant commercial building”) from Company I for 2.74,81.50,000 won.

C. The Plaintiff became aware of the Defendant around March 2010, while trying to perform civil affairs related to the instant building sales business between K and K with the representative of C.

Since then, there has occurred a dispute over multiple monetary transactions with the defendant due to involvement in the defendant's legal issues, etc., the defendant filed a complaint against the plaintiff on the charge of fraud around October 2014.

On December 2010, the Defendant participated in the sale of H building J-ho, which is located in Seongbuk-gu, Seongbuk-gu, Sungnam-si, where the sale of the building was impossible due to the issue of the executory company around December 2, 2010, and caused the victim B to buy it much less than the market price, and in return, the Defendant agreed to receive 300 million won fee from the victim.

However, until October 201, 201, the victim paid only a fee of KRW 15 million and did not pay the remainder. The defendant also knew the victim by deceiving the victim and receiving the remainder of the fee.
