Reasons
Punishment of the crime
[criminal power] On November 28, 2017, the Defendant was sentenced to 10 months of imprisonment with prison labor at the Seoul Central District Court and completed the enforcement of the sentence on July 8, 2018. On November 15, 2018, the Seoul Southern District Court sentenced five months of imprisonment with prison labor at the Seoul Southern District Court for fraud, which became final and conclusive on January 18, 2019, and on April 24, 2019, the judgment became final and conclusive on November 28, 2019.
[2019 Highest 4494] On October 15, 2019, the Defendant: (a) around October 16:25, 2019, at the main point of “D” operated by the victim C in Seoul Special Metropolitan City, Nowon-gu B and the first floor; (b) as if the Defendant did not have the intent or ability to pay the drinking value and would normally pay the said value to the victim; (c) the Defendant was provided with alcoholic beverages equivalent to KRW 30,00 in total at the market price of 14,00,000, a thickness of 14,000, 4,000, and 3,000, the market price of which was 4,00.
Accordingly, the defendant was given property by deceiving the victim.

1. On October 13, 2019, the Defendant committed a crime on October 13, 2019, at “G” restaurant operated by the Victim F in Dobong-gu Seoul, Dobong-gu, Seoul; and on October 23:50, at “G” restaurant operated by the Victim F in Dobong-gu, Dobong-gu, Seoul; the fact means that, despite the absence of the intent or ability to pay the price for alcohol and food, the Defendant ordered the drinking and food as if he were to pay the price.
The Defendant, by deceiving the victim as above, received food equivalent to KRW 15,00,00 in total, such as meltbur 1 flusium flusium and flusium flusium flusium flusium flusium, from the victim.
2. On October 16, 2019, the Defendant ordered the “J” restaurant operated by the victim I located in Gangnam-gu Seoul Metropolitan Government (Seoul) on October 16, 2019, and the fact ordered the payment of alcohol and food as if he did not have the intent or ability to pay the cost of alcohol and food.
As above, the defendant deceivings the victim, and brut it from the victim.
