Reasons
Punishment of the crime
On December 12, 2003, the Defendant sentenced 8 months to larceny in the Busan District Court Branch Branch of the Incheon District Court, 2 years from imprisonment on September 15, 2006 due to the violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Larceny), etc. in the Incheon District Court Branch of the Incheon District Court on April 22, 2009; 2 years and six months from imprisonment due to the violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Larceny) at the Seoul High Court on July 13, 2012; 3 years from imprisonment due to the violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Larceny) at the Seoul High Court on July 13, 2012; 6 months from the Incheon District Court Branch of the Incheon District Court on October 6, 2015 to the punishment for larceny; and
1. Around 01:00 on July 23, 2016, the Defendant, in violation of the Aggravated Punishment, etc. of Specific Crimes (thief) committed a theft against the victim E in front of the D hotel in Bupyeong-si, Bucheon-si, by bC cards owned by the victim E, hypting the ground, by humping the ground, and humping the land, etc., by creshing them. The Defendant, in turn, stolen one hump in an amount equivalent to KRW 100,000,000 at the market price of each one contained in the galth block No. 5 mobile phone in the market price.
2. Violation of the Act on Aggravated Punishment, etc. of Specific Crimes and Specialized Credit Finance Business Act;
A. On July 23, 2016, at around 03:07 and 03:09, the Defendant collected the said E’s credit card (credit card number H) from the victim BGF network management cash withdrawal machine installed at the G convenience store located in Bupyeong-si, Bupyeong-si, as in the preceding paragraph, and withdrawn 600,000 won, in total, each of 300,000 won over two occasions, as cash service, and stolen the cash owned by the said victim, and used the stolen credit card.
B. At around 03:22 on the same day, the Defendant collected the said NAFC card (credit number I), withdrawn 300,000 won as cash services, stolen cash in the said victim’s possession, and used the stolen credit card.
C. The Defendant, at around 03:57 on the same day, is in the first floor of the 180 modern department store, Seocheon-si.
