The defendant's appeal is dismissed.

1. Summary of grounds for appeal;

A. The Defendant had no or weak ability to discern things or make decisions under the influence of alcohol at the time of each of the instant crimes.

B. The lower court’s sentence of unreasonable sentencing (one year and six months of imprisonment) is too unreasonable.

2. Determination

A. According to the record as to the assertion of mental disorder, the fact that the defendant was in a drunken state at the time of each of the crimes in this case is recognized.

However, in full view of the circumstances revealed by the evidence duly adopted and examined by the lower court and the Defendant’s attitude before and after each of the instant crimes, it does not seem that the Defendant did not have the ability to discern things or make decisions under the influence of alcohol at the time of the instant crime.

Therefore, the defendant's argument on this part cannot be accepted.

B. As to the assertion on unreasonable sentencing, the Defendant appears to have expressed an attitude against his mistake in the future to not repeat again.

However, each of the crimes of this case was committed by the Defendant with verbal abuse and intimidation against many victims, and by intrusion upon the victim N’s residence with a deadly weapon, in order to withdraw the property from the said victim, or by theft of money by intrusion upon the said victim’s residence after destroying the entrance door, and thus, the nature of the crimes of this case is very poor in light of the course, method, frequency, etc. of each of the crimes of this case.

In particular, even before each of the crimes of this case, even though there was a history of punishment for the same kind of crime, the defendant committed each of the crimes of this case, and did not receive a letter from the victims.

In addition to these circumstances, the Defendant’s age, character and conduct, environment, motive, means and consequence of each of the instant crimes, etc., all the circumstances constituting the conditions for sentencing, including the circumstances after the crime, and the scope of the recommended sentence according to the sentencing guidelines (at least one year of imprisonment).
