1. The defendant shall pay to the plaintiff the amount of KRW 139,227,188 and the amount of KRW 138,567,327 from January 19, 2021 to the date of full payment.
Reasons
1. Facts of recognition;
A. On September 2019, the Plaintiff entered into a loan agreement with the Defendant on a deposit basis (hereinafter “instant loan agreement”) with a KRW 148 million at the interest rate of 7.5% per annum, and 10.5% per annum, and loaned KRW 148 million to the Defendant.
B. Since then, the grounds for loss of interest under the term under the instant loan agreement occurred, and as of June 10, 2020, the loans the Defendant has to pay according to the instant loan agreement were the principal amounting to KRW 148,00,000,000, and the overdue interest amounting to KRW 788,524.
