A defendant shall be punished by imprisonment for four years.

The defendant shall complete a sexual assault treatment program for 120 hours against the defendant.

1. On March 11, 2014, the Defendant found the victim D (6 years of age), and victim E (6 years of age) playing in the play room in the front of the Heungdong-gu C apartment management office in Chungcheongnam-gu, Chungcheongnam-gu, Cheongju, from March 11, 2014 on the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (an indecent act, such as a minor, deceptive scheme, etc. under the age of 13), and led the victims to the wall of the entrance of the underground parking lot in the place where CCTV was not taken, and caused the victims to keep the victims only from the Defendant’s sexual organ by committing an indecent act.

Accordingly, the defendant committed an indecent act against the victims of less than 13 years of age by fraudulent means.

2. Public performance and obscene;

A. On March 31, 2014, around 17:24, the Defendant discovered that the said victims walk in front of 107 apartment buildings, such as the foregoing paragraph (1), and displayed the Defendant’s boomer and booming his sexual organ to the victims, and openly obscene acts.

B. On April 1, 2014, at around 14:40, the Defendant discovered that the victim D(s), F(s), G(s), H(s), and H(s) are playing at the play place following the apartment management office, such as the above paragraph (1) of the said paragraph, and that the Defendant used the Defendant’s breath, f(s), G(s), H(s) and H(s) to display the Defendant’s boom to the victims, and was made in rubber, and the Defendant used the Defendant’s breath and boomingly obscene act.

3. The Defendant who attempted to commit an indecent act in violation of the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (a minor, deceptive scheme, etc. under the age of 13) shall show his sexual organ before the victims and scamb at the same time and time as paragraph 2(b) of the above Article, and shall cause the victims to drive away from the victims by taking away their sexual organ in the direction of the management office of the apartment complex in which the victims suffered damage.
