The judgment of the court below is reversed.

A defendant shall be punished by imprisonment for six months.

1. With respect to the summary of the grounds for appeal (e.g., imprisonment) by the lower court, the Defendant is deemed to be too uncomfortable and unfair, and the Prosecutor is deemed to be too uncomfortable and unfair.

2. In this case, the crime of this case is very poor that the defendant, while running a credit business without being registered, extended money to C for a long time and received high interest rate of up to 192% in violation of the restriction on the interest rate. The defendant's profit from the crime of this case seems to be considerable; the defendant's profit from the crime of this case appears to be in the illegal collection circumstances such as repeatedly visiting C's pharmacy in the course of the collection of the claim without any justifiable reason and uneasiness; the defendant's demand for the defendant to make a false statement to the effect that he did not contact or not contact with the defendant after summons from the prosecutor at the investigative agency, and did not pay interest; due to the crime of this case of this case by the defendant, C has suffered serious economic and mental suffering to the extent that it was difficult for the defendant to operate his pharmacy, and even if he did not commit suicide, the defendant does not completely deny the crime of this case at the investigative agency and the court below.

On the other hand, when the defendant was found to have committed a crime in the past, the defendant is divided into several occasions, and the defendant expressed his intention to waive the remaining claims without collecting the claims against C, and the agreement with C is reached, and the defendant's health status is not good.

In full view of the above circumstances and the motive leading up to the instant crime, the circumstances after the instant crime was committed, the Defendant’s age, character and conduct, family relationship, environment, occupation, etc., and all other circumstances constituting the conditions for sentencing as shown in the pleadings, the lower court sentenced the Defendant.
