Reasons
Punishment of the crime
[Presumption Facts] Defendant B, as the representative director of C, a corporation located in the D building 206 at Si interest time, vicariously performed the sale of “F” by E Co., Ltd., and Defendant A, as a business member belonging to C, performed the public relations activities such as posting banner.
No person shall display or install advertisements, etc. in areas, places, or objects prescribed by Presidential Decree in order to preserve scenic landscapes and public morals, prevent harm to the public, and create a healthy and pleasant living environment.
[Criminal facts]
1. On August 16, 2016, Defendant A installed five banners for advertisement, stating “I”, on street trees and roadsides, etc., which are objects prohibited from displaying one-time advertisements, etc., such as H in the south-gu Busan Metropolitan City G, including the front side of the road, etc.
2. On August 16, 2016, Defendant B had Defendant B, a business employee of C, install five banners for advertisements with the contents of “I”, etc. as referred to in paragraph (1), on street trees and roadsides, etc., which are objects prohibited from displaying one-way advertisements, such as H in front of the Busan Southern-gu G, Busan-gu, Busan-do.
3. Defendant C, a representative director of the Defendant, committed the same offense as that of the Defendant’s business.
