1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

Reasons

1. Basic facts

A. 1) The Plaintiff, as an affiliate of the Group B, is a company engaged in system consignment and operation, network services, and database services as an affiliate of the Group B. The Defendant is a company engaged in the provision and sale of computer system services. The Intervenor joining the Defendant (hereinafter “ Intervenor”).

(2) On August 10, 2010, the Plaintiff sent a written request for proposal for the project (Evidence A 1) to the companies that deal with the design and development of the electronic data processing system, including the Defendant and the Intervenor, that established a comprehensive computer system for personnel management in Korea and overseas affiliate of the Group B to which the Plaintiff belongs (hereinafter referred to as the “instant project”).

The main contents of the above request for proposal shall be as follows:

1. Summary;

A. Project name: Group B personnel system establishment project;

B. Purposes of project implementation;

i. phasedly establishing a global integrated group personnel system that can provide strategic personnel information for timely use to support the continuous growth of the group and to respond to changes in the environment;

iv. Construction of systems that can ensure the flexibility and expansion of systems that can reflect the environment in and outside of Korea and the systems and regulations of each country;

c. Business implementation strategies;

i. Domestic personnel systems do not use the current system environment and establish a new system.

(v) establishing a governance system, (i) establishing domestic and global group personnel standards and processes through preceding PI, and changing management and governance systems;

ii. The global personnel system is developed with the same platform as the domestic personnel system, and the localization work is conducted concurrently by reflecting regional characteristics, and ① the global basic cycles (such as personnel/organization/evaluation, etc.) are the same as the domestic system.
