Defendants shall be punished by a fine of three million won.
In the event that the Defendants did not pay each of the above fines, only 100,000.
Reasons
Punishment of the crime
1. Defendant A acquired U.S. citizenship around 2009, and lost the Republic of Korea citizenship on July 21, 2009, the first issuance date of the U.S. passport, and accordingly, the passport (number C) issued by the Defendant was invalidated.
A foreigner shall have a valid passport at the time of entry, and at the port of entry and departure where the foreigner departs from the Republic of Korea, he/she shall undergo a departure inspection by an immigration control official.
Nevertheless, on May 13, 2015, the Defendant presented a passport of the Republic of Korea which has already ceased to have effect at the port of entry or departure of Incheon International Airport located at the Jung-gu Incheon Airport on May 13, 2015, and entered or departing from the Republic of Korea by presenting a passport of the Republic of Korea which has already ceased to have effect at the same place as on June 10, 2015, as shown in the attached list of crimes (1).
2. Defendant B, on April 22, 2009, acquired U.S. citizenship, lost the nationality of the Republic of Korea on April 22, 2009, the first issuance date of U.S. passport, and accordingly, the passport (number D) issued by the Defendant was invalidated.
