1. The Defendants are jointly and severally liable to the Plaintiff (designated Parties) A, KRW 5 million to the Appointed C, KRW 71,367,346, and KRW 46 to the Appointed D.

1. Facts of recognition;

A. At around 01:05 on Oct. 26, 2009, Defendant B driven a FIsta taxi (hereinafter “instant vehicle”) owned by Defendant Dong Jae-gu Co., Ltd. (hereinafter “Defendant Company”) and caused the designatedr C to suffer an injury to the left side of the instant taxi, by neglecting the duty of Jeonju City at a speed exceeding 60 km in speed exceeding 43 km per 103 km at a speed exceeding 60 km per two-lanes of the said road, on the Gung Twa road located in the Gungside of Seoul Special Metropolitan City, by neglecting the duty of Jeonju at a speed exceeding 103 km in accordance with the two-lane of the said road.

The Appointor D is the co-born of the Appointor C, the Appointor E is the mother of the Appointor C, and the plaintiff A is the father of the Appointor C.

2. Occurrence of liability for damages;

A. According to the above facts, Defendant B is a party to a tort regarding the instant accident, and the Defendant Company is jointly and severally liable to compensate the Plaintiff and the designated parties for the damages incurred by the Plaintiff and the designated parties due to the instant accident.

B. (1) limitation of liability: Provided, as seen earlier, the Selection C was erroneous in crossing the same as six-lanes from the late night to the late night. Since such error was caused by the occurrence and expansion of damage caused by the instant accident, it shall be considered in calculating the amount of damage that the Defendants should compensate, but in light of the circumstances, etc. of the instant accident, the percentage thereof shall exceed 40%.
