1. The Defendant-Counterclaim Plaintiff (Counterclaim Defendant) indicated the attached sheet No. 1, 2, 19, 18, among the land size of 823 square meters prior to Ulsan-gu, Ulsan-gu C, Ulsan-gu.

1. Basic facts
A. The Plaintiff owns a building of 152 square meters in Ulsan-gu, Ulsan-gu (hereinafter “Plaintiff’s land”) and on its ground, there is a house in which the Plaintiff’s mother-child resides (hereinafter “Plaintiff’s housing”).

가. 본소 ⑴ 점유취득시효 원고는 1982. 8. 28. 피고로부터 피고 토지 중 5평을 매수하고, 이 사건 담장을 쌓고 ㈏부분을 원고 주택의 마당으로 점유사용하고 있는 사실은 앞서 인정하였고, 그 점유자는 소유의 의사로 선의, 평온 및 공연하게 점유한 것으로 추정된다(민법 제197조). 피고는, 원고가 매수한 토지는 5평에 불과하고 ㈏부분의 면적은 47㎡로, 원고가 매수한 토지 면적을 초과하는 부분에 관해 원고는 악의라고...
