Punishment of the crime

피고인은 2011. 4. 9. 14:00경 태백시 G에 있는 H의 집에서, 피고인이 이웃에 사는 E과 담장 문제로 시비가 되어 주민의 서명을 받아 E을 고소하였는데 피해자 I(50세)이 동참하지 않았다는 이유로 불만을 품던 중, 피고인의 처 J이 삿대질하며 피해자에게 "씹할 아저씨가 더 나빠"라고 소리치자 않고 있던 피해자가 일어서면서 "내가 뭘 그렇게 나쁘게 했느냐"라고 하였다는 이유로 화가 나 피고인은 피해자의 가슴을 머리로 1회 들이받아 피해자가 뒤로 넘어지면서 머리를 벽에 부딪치게 하여 피해자에게 약 2주간의 치료가 필요한 뇌진탕 등의 상해를 가하였다.
