Defendants shall be punished by imprisonment for eight months.

However, the execution of each of the above penalties shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[Judgment of the court below] On June 21, 2012, the Suwon-si entered into a contract for the construction of the road (hereinafter referred to as "the construction of the road") and the construction of the road (hereinafter referred to as "the construction of the road") in Suwon-si and Suwon-si, Suwon-si, with the content that the contract amount of the construction of the road shall be KRW 1,61,359,000, and the victim FF Co., Ltd. When paying the cost of transporting soil and sand per 13 cubic meters of soil and sand, F would collect the total cost of transporting soil and sand after collecting the shipment certificate from G.

On November 2012, 2012, Daea Construction submitted the second construction machinery part inspector (the construction cost: 204,639,600 cubic meters) to the effect that he/she transported 5,308 cubic meters (the construction cost: 204,639,600 cubic meters) among earth and sand from 86,707 cubic meters (the design volume was changed to the 86,707 cubic meters after the alteration of the first design) of the total design volume of 88,058 cubic meters (the construction cost was changed to the 86,707 cubic meters) at the water level, and the second construction machinery part inspector to the effect that he/she transported 27,675 cubic meters (the construction cost: 102,397,500 cubic meters) around May 2013, respectively, to the effect that he/she completed the completion inspection of soil and sand transport from around September 2013.
