The prosecution of this case is dismissed.
Reasons
1. The summary of the facts charged is a person who is engaged in driving a motor vehicle with sod vehicle B.
On February 7, 2016, the Defendant driven the above car at around 11:00, and continued the intersection of the shooting distance in front of 4097, the Hocheon-gun, Hocheon-gun, U.S., at a speed of about 60km at a speed of about 60km in Si/Gun.
Since there is a long distance intersection that does not support by traffic control due to the operation of yellow on-and-off signal, the driver of the motor vehicle has a duty of care to check whether there is a vehicle crossing by reducing or temporarily stopping the speed prior to the entry into the intersection, and to safely operate the steering gear and brakes properly so as to prevent accidents in advance.
Nevertheless, the Defendant neglected this while driving the vehicle at a speed, and by negligence proceed to the right-hand side in the left-hand side of the victim C(45 years) driving in the direction of the Defendant’s running, received the back-hand side of the victim C(45 years) driving in front of the Defendant’s driving car.
Ultimately, the Defendant suffered, from the above occupational negligence, approximately 2-day care for the victim E (the 68-year-old) who was accompanied by the victim C driver's car, the duplic of the cuplic of the cuplic of the cuplic of approximately 6-day care for the victim F (the 10-year-old age), and the cuplic of the cuplic of the cuplic of the cuplic of the cuplic of the cuplic of the cuplic of the cuplic of the cuplic of the cuplic of the cuplic of the cuplic of the cuplic of the cuplic of the cuplic of the c.
2. The facts charged in the instant case are crimes falling under Article 3(1) of the Act on Special Cases concerning the Settlement of Traffic Accidents and Article 268 of the Criminal Act, which cannot be prosecuted against the victim’s express intent pursuant to the main sentence of Article 3(2) of the Act on Special Cases concerning the Settlement of Traffic Accidents.
According to the records, the victims have filed the prosecution of this case on 2016.
