1. The Defendant’s KRW 207,980,00 for the Plaintiff and the following: 6% per annum from May 30, 2017 to February 7, 2018.
Reasons
1. On April 24, 2017, the Plaintiff obtained an assignment order (Seoul Eastern District Court 2017TTTT4435) regarding the instant claim attachment and assignment order (Seoul Eastern District Court 2017TTT435) as an executory exemplification of a notarial deed against A (hereinafter “A”, and the other companies omitted the entry of “stock company”) with respect to the amount of KRW 460,401,530, with the executory title of the notarial deed against A, and the said order was served on the Defendant on April 26, 2017 and finalized around that time.
2. The parties' assertion
A. The Defendant is obligated to pay to the Plaintiff the full amount of KRW 460,401,530 and damages for delay.
B. Defendant A’s claim against the Defendant was KRW 207,980,000 in total as follows at the time of the validity of the assignment order of this case against the Defendant of the claim amount ( April 26, 2017) (i) although the title of “B service contract” as of November 18, 2016 is indicated in the “service contract”, the actual content constitutes a contract that covers the supply, installation, and maintenance of equipment.
There is no particular dispute over the fact that both the original Defendant and the Defendant constitute a claim that was incurred under the following contracts constituted a claim that was entirely transferred to the assignment order of this case:
(1) Amount of KRW 165,00,000 for the original contract amount of KRW 15,000 under the contract (a) - KRW 150,000 for the original contract amount of KRW 234,630,000 for the original contract amount of KRW 230,000 = 15,000 for the original contract amount of KRW 200,000 for the claim amount of KRW 300 under the second contract (c) and KRW 191,110,00 for the claim amount of KRW 197,00 for the first contract of KRW 231,00,00 for the first contract amount of KRW 30,00 for the first contract amount of KRW 30,00 for the first contract amount of KRW 300,00 for the first contract amount of KRW 300,000 for the first contract amount of KRW 60,000 for the first contract amount of KRW 10,000 for the above contract amount of KRW 200.
