The prosecution of this case is dismissed.
Reasons
1. On April 2016, the Defendant charges of this case: (a) at the victim C’s house located in the wife B in the Sinsi-si of Sinsi-si of Sinsi-si of Sinsi-si of Sinsi-si of Sinsi-si of Sinsi-si of Sin-si of Sinsi-si of Sinsi-si of Sinsi-si of Sin
Benefits are 10 to 120,00 won per month, and the principal can also be found if they are kept for more than one year.
Goods which may be protected by the Depositor Protection Act may be returned in full.

However, the Defendant was thought to use the money that he received from the injured party to pay his personal debt, and there was approximately KRW 40 million of debt at the time, and even if he did not receive the money from the injured party due to no particular income, he did not have an intention or ability to pay the money after purchasing an insurance policy.
Around April 18, 2016, the Defendant: (a) by deceiving the victim as above; and (b) transferred KRW 10 million to one bank account (D) in the name of the Defendant from the victim; and (c) KRW 20 million to the same account around the 19th day of the same month, respectively.
2. The facts charged of the instant case are crimes falling under Article 347(1) of the Criminal Act, and under Article 328(2) of the Criminal Act, which is applicable mutatis mutandis by Article 354 of the Criminal Act, in a case where the victim and the offender have a relationship of kinship as prescribed by the said Article, the prosecution may be instituted only upon the victim’s complaint.
According to the records, the defendant's spouse, who is the victim E, has kinships with the victim under Article 328 (2) of the Criminal Act, and the victim can recognize the fact that he/she revoked the complaint against the defendant on July 10, 2018, which was after the prosecution of this case. Thus, the prosecution of this case is dismissed in accordance with Article 327 (5) of the Criminal Procedure Act. It is so decided as per Disposition.
