Reasons
1. The reasons why this court should explain are as follows: (a) the 20th 20th 3rd 20 of the judgment of the court of first instance is the same as the part of the judgment of the court of first instance, except where the 20th 20th 3rd 20 "the plaintiff's intention or negligence" is "the defendant's intention or negligence"; and (b) thus,
2. The assertion and judgment
A. (1) As to a tort, the Plaintiff asserts that, through the instant claim, the Defendant spreads false facts to media organizations, the National Assembly, government agencies, etc., thereby undermining the Plaintiff’s reputation and credit, and that, due to the Defendant’s false information, the Plaintiff has a duty to compensate the Plaintiff for property and mental damage for about one year from October 2012 to August 2013, 201, the Plaintiff appeared at the media organizations, the National Assembly, the Board of Audit and Inspection, the Office of Prime Minister, the National Railroad Workers’ Union, the Presidential Transition, the Ministry of Land, Transport and Maritime Affairs, the National Police Agency, and the Anti-Corruption and Civil Rights Commission, etc., which had been ordered by the Plaintiff.
On the other hand, the defendant asserts that the defendant's act of notifying the state agency's improper suspicion is not unlawful, since it is the right of the people for the public interest.
(2) Article 751(1) of the Civil Act provides for the tortfeasor's liability for damages other than property caused by a tort. Damage other than property does not mean only mental pain, but also includes intangible damage which can be assessed in light of social norms. Thus, a person who has damaged a corporation's reputation or credit is liable to compensate the corporation for damages other than property, and the act that has damaged the corporation's reputation or credit includes all acts that undermine the corporation's social assessment to the extent that it could affect the corporation's performance of its purpose of business.
