A defendant shall be punished by imprisonment for not more than ten months.

except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant, as a actual borrower of C, D, and E-business trucks, has the authority to claim and receive fuel subsidies from the local government with which the vehicle is registered, and, in order to receive fuel subsidies, the Defendant: (a) was prohibited from purchasing oil to move and sell at a place other than a gas station or from purchasing oil in which the source of the vehicle is unknown at a fixed facility of the gas station or self-owned oil station; (b) was provided with oil not known through the tank lorri vehicle on February 2014; and (c) was provided with oil not known through the tank lorri vehicle in operation, such as F, G, and H, which were supplied to the trucker; and (d) settled the payment with the credit card terminal of the oil station in which the said F, etc. is in possession, thereby deceiving the local government to purchase the oil normally from the fixed facility of the oil station or self-owned oil station, thereby soliciting the local government to receive fuel subsidies.

On February 15, 2014, the Defendant: (a) around 20:15, on the street in the south-gu Busan Metropolitan City, the Defendant: (b) deposited 121 liter of oil, which is not known of the source of approximately KRW 200-300 per liter (200,000) compared to the normal transit market price, through the mobile-type tank oil vehicle in the south-gu, Busan Metropolitan City via the mobile-type truck in the same line; (c) delivered the freight driver welfare card (Korean card I) under the name of the Defendant to the said F to pay the price using a credit card terminal in the name of the “Korea Oil Station” located in Ulsan-gu, Ulsan Metropolitan City; and (d) around that time, the Defendant stated that the Defendant was believed to purchase the same through normal transit at the above oil station from around 345 won per liter-gun, Busan Metropolitan City Council from around 14, 201 to around 15, 2015, as shown in the attached Table 3415.
