A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
around March 10, 2018, the Defendant stated that “A seafarer will be on board as C from May 1, 2018 to December 31, 2018, at the Seo-gu auction house at Seo-gu, Seo-gu, Seo-gu, Jeju, that “A seafarer will be on board as C seafarer from May 1, 2018 to December 31, 2018,” respectively.
However, the defendant did not have the intention or ability to work as a seafarer on the ship of the victim.
As above, the Defendant, by deceiving the victim and receiving 500,000 won from the victim under the name of advance payment on the same day, was delivered to the victims in total three times from that time to April 16, 2018 by the same method as the list of crimes in the attached Table.
"2018 Highest 2475"
1. Around March 10, 2018, the Defendant, on March 10, 2018, made a false statement to the victim E from Seopopo-si, Seopo-si, that “The Defendant will board F seafarer for one year, per week, 2.5 million won in advance payment.”
However, the defendant did not have the intention or ability to work as a seafarer on the ship of the victim.
As above, the Defendant, by deceiving the victim, received KRW 2.5 million from the victim on March 14, 2018 under the pretext of advance payment.
2. Around March 28, 2018, the Defendant called the victim E at a Buddhist place of not more than Jeju on March 28, 2018, and falsely stated that “If a wife dies and loans KRW 4 million as funeral expenses fall short of the funeral expenses, he/she would make a funeral and make a partial repayment with the insurance money and make a payment from F.”
However, in fact, the defendant did not die and did not have the intention or ability to work as a seafarer on the victim's ship.
As above, the Defendant, by deceiving the victim, received 4 million won as funeral expenses from the victim on the same day.
