The instant lawsuit is dismissed.

Litigation costs shall be borne by the plaintiff.

Basic Facts

The Plaintiff is a company running the rearrangement project management business, etc., and the Defendant is the promotion committee established to implement the housing redevelopment project (hereinafter “instant project”) whose project implementation district covers 15,457m2 in Dongdaemun-gu Seoul, Dongdaemun-gu Seoul.

On December 28, 2019, the Defendant announced a public announcement of the selection of a management entity specialized in improvement projects for the instant project by means of general competitive bidding according to the "Standards I for Qualification of a management entity specialized in improvement projects of public support in Seoul Metropolitan City."

On January 6, 2020, the defendant held the site site conference, issued bid guidelines to the companies present at the site site conference, and Article 8A of the above bidding guidelines.

Paragraph (1) provides that "the ordering person shall select a management entity specialized in improvement projects of at least the top four persons (in the case of less than four persons, all of them) to be presented at a general meeting pursuant to Class I of Article 3, from among bidders meeting the qualifications of the management entity specialized in improvement projects of public support in Seoul, and refer the management entity to a general meeting of residents and shall be decided by vote at a

Paragraph (1) provides that "The allocation of marks of business entities belonging to a general meeting shall be made in the order of evaluation."

From January 6, 2020 to January 17, 2020, the Defendant offered a bid to select a management entity specialized in improvement projects (hereinafter “instant bid”), and received the highest score from among 22 enterprises participating in the instant bidding.

The defendant notified the head of Dongdaemun-gu to the head of the bid results of this case. According to the authoritative interpretation of the Ministry of Land, Infrastructure and Transport related to whether the defendant could succeed to the partnership of the management entity specialized in improvement projects on January 31, 2017, the management entity specialized in improvement projects selected in excess of the scope of the business at the promotion committee level pursuant to Article 5 of the Operational Rules for the Development Promotion Committee of Rearrangement Projects does not succeed
