1. The defendant shall not exceed 48,197,137 won and 48,197,071 won among them within the scope of property inherited from the deceased A.

As the Plaintiff’s assertion as stated in the cause of the claim and the death of A, the Defendant filed a report on the inheritance limited recognition with the Changwon District Court 2015-Ma673 on July 2, 2015 and received the Plaintiff’s claim on July 9, 2015, since there is no dispute between the Plaintiff and the Defendant as to the acceptance of the said report.

However, since the amendment of the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings, the statutory interest rate applied after October 1, 2015 has been changed to 15% per annum, the part claiming damages for delay by 20% per annum from the Plaintiff’s claim is limited to the said changed statutory interest rate from October 1, 2015.

Therefore, the plaintiff's claim is justified within the scope of the above recognition, and the remaining claims are dismissed as it is without merit. It is so decided as per Disposition.
