A defendant shall be punished by imprisonment for four months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. "2017 Highest 5,277";

A. On September 18, 2017, the Defendant: (a) around 22:50 on September 18, 2017, placed the victim’s “E” restaurant operated in Daegu-gu, Daegu-gu, as if he would pay the amount to the victim; and (b) placed an order of alcohol and alcohol. However, the Defendant did not have certain income or property; and (c) the Defendant did not have any cash or credit card or other means of payment, and thus, did not have the ability to pay the amount even

Nevertheless, the defendant deceivings the victim as above, and was issued the walker's 26,00 won in total at the market price from the injured party.

Accordingly, the defendant was given property by deceiving the victim.

B. On August 19, 2017, the Defendant ordered meal and alcohol at the H “H” restaurant managed by the victim G in Daegu-gu, Daegu-gu. However, in fact, the Defendant did not have certain income or property, and even if he did not possess cash or credit cards or other means of payment, and thus ordered alcohol, alcohol, etc., the Defendant did not have the ability to pay the price.

Nevertheless, the Defendant: (a) by deceiving the victim; and (b) obtained the delivery of 19,400 won in total from the injured party, of 19,400 won in the market value; (c) a small-scale one, 2-C, and 1-Cra.

Accordingly, the defendant was given property by deceiving the victim.

2. On October 11, 2017, the Defendant, around 22:10, 2017, ordered “K” restaurant operated by the victim J, Daegu-gu, Seo-gu, to pay the amount to the victim. However, the Defendant did not have the ability to pay the amount even if he/she orders alcohol, alcohol, etc. because he/she did not have certain income or property and does not have cash, credit cards, etc., and does not have any means of payment.

Nevertheless, the defendant deceivings the victim as above and is equivalent to 22,00 won in total from the victim.
